JUSTICE PRESS RELEASE
Defence safeguards sidelined in favour of tougher policy on fighting crime
JUSTICE, the all-party law reform group and human rights organisation, today commented on the 10 June European Commission ‘Communication to the European Parliament and Council on an area of freedom, security and justice serving the citizen’ which will form the Stockholm Programme.
The Communication signals the culmination of the Hague Programme, which set out the priorities for action in this area for the previous five years. The Stockholm Programme, which will set the agenda for 2010 to 2014, will be adopted during the Swedish Presidency, beginning on the 1 July.
The Programme recommends further harmonisation of EU criminal law in the fight against international organised crime. It advocates more effective police cooperation and procedural instruments to achieve this.
Whilst it suggests that focus will be on ‘Promoting citizen’s rights – a Europe of rights’ and acknowledges that there has been a failure to adopt minimum defence safeguards in criminal prosecutions, in a document spanning 34 pages of detailed recommendations, the only suggestion made in this area is,
[T]he rights of the defence will have to be strengthened. Progress is vital not only to uphold individuals’ rights, but also to maintain mutual trust between Member States and public confidence in the EU. Under an action plan setting out a thematic approach, the work on common minimum guarantees could be extended to protection of the presumption of innocence and to pre-trial detention (duration and revision of the grounds for detention).

The Swedish Presidency has indicated its commitment to the promotion of procedural safeguards for defendants through the announcement that it will present a roadmap detailing the defence rights that it intends to promote during its presidency of the EU. It is incredibly disappointing that the Commission has made no effort to prioritise the adoption of defence safeguards in the Stockholm Programme. Ten mutual recognition prosecution focussed instruments have been adopted by the Justice and Home Affairs Ministerial Council in recent years. Defence safeguards have been shown to vary widely across the Member States of the EU, with poor legal aid provision, access to a lawyer and interpretation and translation key areas for concern. It is imperative that action is taken to address this discrepancy if mutual recognition instruments are to continue to be implemented. Sweden will make this a priority of its presidency. This priority should be reflected in the Programme, which will shape the next five years.

1. The Commission proposed a framework decision on certain procedural rights in criminal proceedings throughout the European Union COM (2004) 328 final, but the Justice and Home Affairs Council failed to adopt the instrument in 2007, due to disagreement from six Member States including the UK. Adoption of instruments under the third pillar requires unanimity.
2. It is anticipated that the Swedish Presidency will announce its roadmap, favouring focus on one right at a time, at the outset of its presidency on 1 July 2009. This will be followed by a Commission proposal for a framework decision on interpretation and translation, anticipated on the 8 July.

Bidrag beviljat från Folke Bernadotteakademin
ICJ-S är glada över att ha blivit beviljade bidrag från Folke Bernadotteakademin för att med början hösten 2009 till våren 2011 genomföra ett antal rättegångsobservationer i Västsahara. Till projektet kommer ICJ-S behöva rekrytera rättegångsobservatörer ur vår medlemsbas.

Nätoperatörer ska från och med den 1 januari 2010 tvingas spara alla användaruppgifter i ett halvår för att underlätta för brottsbekämpning. Det skriver justitieminister Beatrice Ask i en ännu opublicerad lagrådsremiss, och vill därmed fylla den lucka i lagen som i dag gör att operatörerna kan vägra lagra uppgifterna.

Idag har ICJ publicerat en rapport ”Assessing, Damage, Urging Action”.
Rapporten är framtagen av en oberoende panel bestående av ledande MR-jurister, bland andra Mary Robinsson som är ICJs president. Panelen har genomfört en extensiv studie om ”counter-terrorism” och mänskliga rättigheter. Studien omfattar fler än 40 länder världen över.
